The determination of the Tribunal was as follows:
At the outset of this hearing the respondent told the Tribunal that it was conceding that its dismissal of the claimant was unfair. Since compensation was the preferred remedy a difference emerged on the quantum due to the claimant.
Having heard evidence from the claimant and the respondent in relation to their financial and working arrangements, the Tribunal makes an award of €16,150.00 to the claimant under the Unfair Dismissals Acts, 1967 to 2007. This sum is based on evidence of the claimant’s gross weekly wages, his efforts to mitigate his loss, and his subsequent involvement in furthering his education and availability for employment.
