Background:
The case against the 2nd named respondent was withdrawn at the outset.
An email dated the 12th April 2013 was submitted by the third named respondent in this case to state the company was “forced to close” their Dublin/ROI operations as of the 8th March 2013 and they “ will not be in attendance or represented at hearing(s) as this company has now been dissolved”.
The claim under the Unfair Dismissals Acts 1977 to 2007 was withdrawn.
Claimant’s case:
The claimant told the Tribunal that he began work with the third named respondent (who were an employment agency) possibly sometime in 2010. He said that he worked on various assignments with a range of employers, including a bakery, assembling furniture, cleaning and refuse collecting. The third named respondent paid his wages at all times. His complaint form was submitted with a date of cessation of employment of 29th December 2012.
No evidence was made available to the Tribunal of 104 weeks continuous service with any of the named respondents. The claim under the Redundancy Payments Acts 1967 to 2007 therefore must fail.
