Appellant’s case:
The appellant was employed by the respondent from 10th October 2006 until he was dismissed, without notice, by way of redundancy on 16th May 2013.
At the time of his redundancy the appellant was earning €400.00 per week. The appellant was due 5 days annual leave and 4 days in lieu of public holidays at the date of his redundancy and did not receive payment in lieu of these.
Determination:
There was no appearance by or on behalf of the respondent and the Tribunal is satisfied that the respondent was properly served with notice of the hearing.
Having considered the uncontested evidence of the appellant the Tribunal awards the appellant €1,600.00, being 4 weeks wages, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
The Tribunal also awards him €720.00 in respect of holiday pay under the Organisation of Working Time Act, 1997.
