The decision of the Tribunal was as follows:-
This case came before the Tribunal by way of an appeal by the employer against the decision of the Rights Commissioner under the Payment of Wages Act, 1991 (ref. 125978-pw-12/MH).
Determination:
The appellant agreed that he did not notify the respondent of his intention to appeal the decision of the Rights Commissioner decision, ref. r-125978/pw-12/MH) as specified by section 7(2)(b) of the Payment of Wages Act, 1991. Consequently, the Tribunal does not have jurisdiction to hear the appeal and therefore the decision of the Rights Commissioner is upheld.
