APPEAL OF: CASE NO.
Jacinta Mc Cullough - appellant RP2/2014
Against
CRLA Limited - respondent
under
REDUNDANCY PAYMENTS ACTS, 1967 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms. M. Levey B.L.
Members: Mr D. Peakin
Mr N. Dowling
heard this appeal at Dublin on 21st August 2014.
Representation:
Appellant: Mr. Kevin Callan BL, instructed by Ms. Patricia Holohan, Patricia Holohan & Co, Solicitors, Ground Floor, 24 Laurence Street, Drogheda, Co. Louth
Respondent: Mr. Edward Matthews, 3 St. Audoens Terrace, Christchurch, Dublin 8
The decision of the Tribunal was as follows:-
Determination:
The respondent conceded that a redundancy situation applied in this case. The Tribunal notes that the representative for the respondent company indicated a willingness to pay the appellant her redundancy entitlement in instalments of €300.00 per month. This was subsequently refused by the appellant.
The Tribunal finds that the appellant is entitled to a redundancy lump sum under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria:
Date of Commencement: 1st January 2003
Date of Termination: 20th December 2012
Gross Weekly Wage: €613.00
It should be noted that a statutory weekly ceiling of €600.00 currently applies to payments from the Social Insurance Fund.
This award is made subject to the appellant fulfilling current social welfare requirements in relation to PRSI contributions.
