The decision of the Tribunal was as follows:
It was the appellant’s evidence that his employment had transferred to the respondent company. When this company dissolved however his full service was not been taken into account in calculating the redundancy payment.
Based on his uncontested evidence the Tribunal finds that the appellant’s employment did transfer to the respondent company. The appellant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Birth: n/a
Date of Commencement: 8 August 2008
Date of Termination: 19 October 2012
Gross Weekly Pay: €432.69
The Tribunal notes that the appellant has been paid part of this calculation (€2,483.64) and is due the remaining balance.
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
