Determination:
It was common case that the appellant was dismissed by way of redundancy. However the respondent has ceased to operate and is unable to pay the appellant the balance of his redundancy lump sum due to financial restrictions.
The appellant already received €3,050.00 as part payment of his redundancy lump sum.
The appellant was dismissed by way of redundancy and is entitled to a redundancy payment based on the following:
DOB:
Service from: 01/03/2010 to 05/03/2013
Normal weekly remuneration: €606.30
Amount of redundancy payment: €4224.00 less €3,050.00 already paid = €1,174.00
This award is subject to the appellant having been in employment which is insurable for all purposes under the Social Welfare Consolidation Act, 2005.
