The decision of the Tribunal was as follows:-
Following employment from November 2010 to summer 2012 it was alleged that the claimant’s job was terminated without minimum notice and without receipt of pay for twenty-two days’ holidays outstanding to her. As an operations manager her gross weekly pay was €1,250.00.
No evidence was offered to dispute the claims made.
Determination:
On the uncontested evidence of the claimant, the Tribunal awards her the sum of €1,250.00 (one week’s gross pay) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, and €5,500.00 (4.4 weeks’ gross pay at €1,250.00 per week) in respect of outstanding holiday entitlements under the Organisation of Working Time Act, 1997.
