1. P45 & P60
BACKGROUND:
2. This dispute concerns the Worker's claim that his Employer failed to provide his P45 and P60. The Worker referred this case to the Labour Court on 17th December, 2014, in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on 8th April, 2015. The Employer declined to attend the hearing.
WORKER'S ARGUMENTS:
3. 1. The Worker ceased employment with the Employer in October 2014.
2. The Worker was not provided with his P45 and P60.
3.The Employer should provide the Worker his P45 and P60.
RECOMMENDATION:
The claim before the Court was brought under Section 20(1) of the Industrial Relations Act 1969 and concerns the Claimant’s claim against his former Employer for a copy of his P45 and P60. The Employer did not attend the hearing.
The Claimant was employed by the Employer from 18thAugust 2013 until his employment ceased on 21stOctober 2014.
The Court can see no reason why the Employer should not provide the Claimant with his right to a copy of his P45 and P60 and hereby recommends that these documents should be furnished to the Claimant within four weeks of the date of this Recommendation.
