1. Unfair Dismissal
BACKGROUND:
2. This dispute concerns the Worker's unfair dismissal claim. The Worker referred this case to the Labour Court on 20th February, 2015, in accordance with Section 20(1) of the Industrial Relations Act, 1969, and agreed to be bound by the Court's Recommendation. A Labour Court hearing took place on 24th April, 2015. The Company declined to attend the hearing.
RECOMMENDATION:
The matter before the Court was brought under Section 20(1) of the Industrial Relations Act 1969 and concerns a claim of unfair dismissal.
The named Employer in this case, BT Communications Ireland Limited, did not attend the hearing. It did, however, send communication to the Court stating that it was not the Claimant’s employer; he was employed by an employment agency and supplied to it on a contract for service basis to work on a temporary project.
The Court is not satisfied that the named employer in this case is the correct Respondent and accordingly makes no findings against BT Communications Ireland Limited. Therefore the Court finds that the complaint submitted by the Claimant is not well founded.
The Court so Recommends.
