Determination
By letter of the 5th of March 2015 the receiver notified the Tribunal that they would not be attending the hearing. The appellant accepted voluntary redundancy but the paperwork required in order for her to claim a redundancy lump sum was never completed by the respondent. The Tribunal is satisfied that the appellant is entitled to a redundancy lump sum under the Redundancy Payments Acts, 1967 to 2007 based on the following;
Date of Commencement: 15th May 1998
Date of Termination: 3rd November 2013
Gross Weekly Wage: €1,215.00
This award is made subject to the appellant being in insurable employment under the appropriate Social Welfare Acts during the relevant period. Please note that there is a statutory ceiling of €600.00 for all payments from the Social Insurance Fund.
The appellant is awarded €9,720.00 being the equivalent to 8 weeks’ pay in lieu of notice under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
The appellant is awarded €4,860.00 being the equivalent to her full statutory entitlement of 20 days holidays under the Organisation of Working Time Act, 1997.
