There was no appearance by or on behalf of the respondent and the Tribunal is satisfied that he was properly notified of the hearing.

Claimant’s case:

The appellant commenced employment with the respondent on 15^th January 1997 and was absent on sick leave from 2^nd December 2010 until the business closed down on 21^st December 2011. At the date of termination the appellant’s rate of pay was €376.23 per week.

The appellant never received a redundancy lump sum.

Determination

Having considered the uncontested evidence of the appellant the Tribunal awards her a lump sum redundancy payment under the Redundancy Payments Acts, 1967 to 2007 based on the following criteria.

This award is made subject to the claimant having been in insurable employment, during the relevant period, in accordance with the Social Welfare Acts.
