Determination:
The Appellant in this case was paid a redundancy lump sum payment based on his gross weekly pay being €106.00, per week. The Appellant has brought a claim under the Redundancy Payments Acts, 1967 To 2007, because he contends that his redundancy payment should be calculated on a higher gross weekly amount of €356.25.
Having heard all of the evidence adduced and taking into account all of the information regarding the Appellant’s hours and pay and Schedule 3 of the 1967 Act as amended the Tribunal determines that the Appellant’s average gross weekly pay to be €218.50. Accordingly the redundancy lump sum calculation should be based on the following information:
