The decision of the Tribunal was as follows:
Having heard and considered the brief submissions of the parties and noting the respondent was not contesting this appeal the Tribunal is satisfied that the appellant’s employment with the respondent ceased by way of redundancy. Accordingly, the appeal under the Redundancy Payments Acts, 1967 to 2007 is allowed and the appellant is awarded a statutory redundancy lumpsum under those Acts, and based on the following:
Date of Commencement: 20 October 2008
Date of Termination: 28 March 2013
Gross Weekly Wage: €950.00
This payment is based on the assumption that the appellant was in insurable employment during the above period.
A weekly statutory ceiling of €600.00 applies to payments from the Social Insurance Fund.
