1. Complaint that Rights Commissioner's Decision R-138070/139107-MRT-13/RG has not been implemented.
BACKGROUND:

The Worker referred his case to the Labour Court in accordance withSection 20 of the European Communities (Road Transport) (Organisation of Working Time of Persons Performing Mobile Transport Activities) Regulations 2012-S.I. No.36.2012on the 27th January, 2015. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under Section 20 of the European Communities (Road Transport) (Organisation of Working Time of Persons Performing Mobile Transport Activities) Regulations 2012-S.I. No.36.2012 by Mr. Slawomir Kowal, c/o Blazej Nowak, 107 Amiens Street, Dublin 1 that, Henry Transport Limited, 28 Seatown Place, Dundalk, Co. Louth, failed to implement a decision of a Rights Commissioner, No. r-138070-mrt-13/RG and No. r-139107-mrt-13/RG dated 7thAugust 2014.
And the said decision not having been carried out by the employer,
And no appeal having been brought against the said decision within the time limit for such appeals,
The Court hereby determines that the said Respondent must pay the Complainant the sum of €600.00 in accordance with the decision of the Rights Commissioner.
