APPEAL(S) OF: CASE NO.
Gabriel Alcantara TE76/2014
against the recommendation of the Rights Commissioner in the case of:
Tesco Ireland Limited
under
TERMS OF EMPLOYMENT (INFORMATION) ACT, 1994 AND 2001
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr. C. Corcoran BL
Members: Mr. A. O'Mara
Mr. F. Barry
heard this appeal at Dublin on 15th January 2015
Representation:
Appellant: Mr. Richard Grogan, Richard Grogan & Associates,
Solicitors, 16 & 17 College Green, Dublin 2
Respondent: Mr. Tiernan Doherty IBEC, Confederation House

This case came to the Tribunal as an employee appeal under the Terms of Employment (Information) Acts, 1994 and 2001, against Rights Commissioner Recommendation r-139545-te-13/RG.
The appellant’s case was based on strict breaches of the legislation as technically required. However, it was not clear that the appellant had incurred any loss therefrom for which the appellant should be compensated. This subject matter was presented to the Tribunal.
Determination:
The Tribunal having carefully considered the appeal under the Terms Of Employment (Information) Act, 1994 And 2001, determines that the appeal fails and upholds the Decision of the Rights Commissioner ref: r-139545-te-13/RG.
