The determination of the Tribunal was as follows:-
Claimant’s Case:
The claimant was head hunted by the respondent and joined the company in the role of Financial Accountant on 11th October 2010.
She commenced maternity leave in June 201l. An Accountant was hired as a Project Manager during her absence on maternity leave.
The claimant returned to work on 3rd January 2012.
On 13th January 2012 the Financial Controller called both the claimant and her colleague D into his office. Both the claimant and her colleague were told that they were being let go.
The claimant was not given any notice of the meeting. She was not offered an alternative position or afforded any opportunity to work a three day week or take a pay cut.
The claimant secured a three month contract on 11th March 2013 with another company and was subsequently made permanent in this role.
Respondent’s Case:
No evidence adduced as there was no appearance by or on behalf of the respondent.
Determination:
The Tribunal is satisfied that the respondent was duly notified of the hearing. Having heard the uncontested evidence of the claimant the Tribunal finds that she was unfairly dismissed and awards her €15,000.00 under the Unfair Dismissals Acts, 1977 to 2007.
