Background:
This appeal came before the Tribunal by way of an employee (the appellant) appealing against a Rights Commissioner Decision reference: r-124927-ud-12/JT.
The determination of the Tribunal was as follows:-
The receivers of the company were put on notice of the hearing. Neither the receivers nor a representative on their behalf attended the hearing
It was the uncontested evidence of the appellant that he was unfairly dismissed from his employment with the respondent company. The Tribunal awards the appellant compensation in the sum of €15,000 under the Unfair Dismissals Acts, 1977 to 2007, taking into account his financial loss and his efforts to mitigate same. Accordingly, the Tribunal upsets the decision of the Rights Commissioner reference: r-124927-ud-12/JT.
