This case came before the Tribunal by way of an appeal by a former employee against a recommendation of a Rights’ Commissioner Reference r-108003-ud-11/DI
The determination of the Tribunal was as follows:
The Tribunal is satisfied that the appellant was properly notified of this hearing.
Neither the appellant nor a representative on his behalf appeared for this hearing.
In giving the appellant additional time to appear, the secretariat phoned the appellant at the numbers he supplied. Voice messages were left on those phones. However, no response emerged from those calls.
Having further satisfied itself that all reasonable efforts were made to contact the appellant the Tribunal proceed to hear the case.
In the absence of the appellant and/or his representative to prosecute his case the Tribunal finds that the appeal is dismissed for lack of prosecution.
Accordingly, the Tribunal upholds the recommendation of the Rights’ Commissioner in this case under the Unfair Dismissals Acts, 1977 to 2007.
