The decision of the Tribunal was as follows:-
This is a claim for minimum notice under the provisions of the Minimum Notice and Terms of Employment Acts, 1973 to 2005. The claimant was working on the respondent’s behalf but she accepts that her contract of employment was with a third party company. The claimant also accepts that she received payment in lieu of her statutory notice entitlement from the third party company. However she claims that she was contractually entitled to a longer period of notice, which she was not paid. The Tribunal’s jurisdiction only extends to the issue of statutory notice and it has no jurisdiction in relation to contractual notice entitlements.
As the claimant accepts that she receive her statutory notice entitlement Tribunal has no option but to dismiss the claim.
