The decision of the Tribunal was as follows:-
The appellant claimed that his employment, which commenced on 12 September 2005, following a car accident on 9 July 2010 after which he had been out, ended when the company closed in late 2013. He claimed that his employment had eventually ended by reason of redundancy. His gross weekly pay was €348.00. When working, he had also received expenses.
A hearing notice was sent to the respondent but no evidence was offered by or on behalf of the respondent at the hearing.
Determination:
Under the Redundancy Payments Acts, 1967 to 2007, the Tribunal finds that the appellant is entitled to a redundancy lump sum based on the following details with his reckonable service ending when he became unfit for work:
Date of commencement: 12 September 2005
Date of termination: 9 July 2010
Gross weekly pay: €348.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
