Determination:
There was no appearance by or on behalf of the employer. The Tribunal is satisfied that proper notification was sent to the employer.
The Tribunal heard the uncontested evidence of the Claimant. The Claimant was employed in the Respondent restaurant / wine bar as a commis chef. The Claimant explained that on or about 10th July 2013 the head chef was in an angry mood and told him using loud expletives to leave the kitchen. The Claimant got two waitresses to witness the situation.
The Tribunal heard evidence as to the Claimant’s loss.
The Tribunal determines that the Claimant was unfairly dismissed. Accordingly, the Tribunal determines compensation to be the most appropriate remedy and awards the Claimant the sum of €5,850.00, under the Unfair Dismissals Acts, 1977 to 2007.
