Determination
The Tribunal is satisfied that both parties were properly on notice of the hearing. The Tribunal was aware from written correspondence received that there would be no attendance or representation on behalf of the respondent at the hearing.
Based on the uncontested evidence of the claimant the Tribunal is satisfied that he was unfairly dismissed from his employment. The Tribunal heard detailed evidence in relation to his efforts to secure alternative employment since his dismissal. In that regard the Tribunal was provided with written documentation outlining his efforts to secure employment, and is satisfied that he has made ongoing genuine attempts to secure permanent alternative employment, but without success.
Taking all of the above circumstances into consideration the Tribunal awards compensation in the sum of €45,000.00 under the Unfair Dismissals Acts 1977 to 2007.
As no evidence was adduced in relation to the claim under the Minimum Notice and Terms of Employment Acts 1973 to 2005 the Tribunal dismisses this claim.
