Respondent’s case:
The respondent was represented by a current director of the respondent. However this director was not involved in the termination of the claimant’s employment and could offer no evidence in respect of what occurred.
Claimant’s case:
The claimant made a complaint of bullying against the manager of the respondent and subsequently went on sick leave due to stress. Her complaint was never dealt with by the respondent and she was dismissed while absent on sick leave. The claimant’s role was filled by another member of staff who told the Tribunal that she was asked by the manager to take over this role and when she questioned whether this was legal the manager told her that he knew the law like the back of his hand.
At the time of her dismissal the claimant was earning €350.75 gross per week. The claimant gave evidence in respect of her efforts to find alternative employment after she was dismissed by the respondent.
Determination:
Having considered the uncontested evidence of the claimant the Tribunal finds that she was unfairly dismissed by the respondent.
Having considered the claimant’s efforts to mitigate her losses and in all the circumstances the Tribunal awards her €10,000.00 under the Unfair Dismissals Acts, 1977 to 2007.
