against the recommendation of the Rights Commissioner in the case of:

-v-
Razors Barber Shop
under

I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms P. Clancy
Members: Mr. T. Gill
Ms H. Kelleher
heard this appeal at Limerick on 2nd November 2015
Representation:
Appellant: Mr. Pat Ryan c/o Razors Barber Shop, 21a High Street, Shelbourne Road, Thomondgate, Limerick
Respondent: No appearance or representation
Determination:
This appeal is before the Tribunal by way of an employer appealing a Decision of a Rights Commissioner under the Payment of Wages Act, 1991, ref: r-139648-pw- 13/GC. Therefore the employer is being known as the Appellant and the employee as the Respondent.
There was no appearance by or on behalf of the Respondent employee. The Tribunal is satisfied that proper notification was sent to the Respondent employee.
Having heard the uncontested evidence of the Appellant employer the Tribunal finds that the appeal succeeds and the Decision of the Rights Commissioner under the Payment of Wages Act, 1991, ref: r-139648-pw- 13/GC, is set aside.
Sealed with the Seal of the
