Determination:
The Tribunal is satisfied that notification of the hearing was sent to the registered address of the respondent. The appellant confirmed that the above-named respondent was her employer and that her employment ended when the business closed. Based on the appellant’s uncontested evidence the Tribunal finds that she is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 1 August 2006
Date of Termination: 14 May 2014
Gross Weekly Pay: €467
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The Tribunal also finds that the appellant is entitled to the sum of €1,868 (being the equivalent of four weeks’ gross pay) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 and the sum of €467 under the Organisation of Working Time Act, 1997, for five days annual leave outstanding.
