Determination:
The Tribunal are satisfied the respondent was properly notified of the date, time and location of the hearing. Neither they nor a representative on their behalf attended on the day. The claim under the Redundancy Payments Acts was withdrawn by the appellant’s representative at the outset of the hearing.
Based on the uncontested sworn evidence adduced by the appellant the Tribunal allows the claim lodged under the Minimum Notice and Terms of Employment Acts, 1973 to 2005, the Tribunal awards the appellant the sum of €1,480.00 (this amount being equivalent to four weeks’ gross pay at €370.00 per week).
In addition, the Tribunal awards the appellant the sum of 440.00 under the Organisation of Working Time Act, 1997, in respect of holidays outstanding at the time of termination of her employment with the respondent.
