The determination of the Tribunal was as follows:
The Tribunal is satisfied that the respondent was properly notified of this hearing. Neither the respondent nor a representative on its behalf appeared for this hearing.
Having heard and considered the claimant’s evidence the Tribunal finds his employment with the respondent was terminated by way of redundancy. Accordingly, the appeal under the Redundancy Payments Acts, 1967 to 2007 is allowed and the claimant is awarded a statutory lump sum payment under those Acts based on the following:
Date of Commencement: 27 January 1999
Date of Termination : 10 October 2014
Gross Weekly Wage: €1057.00
This award is made subject to the claimant having been in insurable employment under the Social Welfare Acts during the relevant period.
A weekly statutory ceiling of €600.00 applies to payments from the Social Insurance Fund.
The appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 succeeds and the Tribunal awards the claimant €8456.00 as compensation for eight weeks outstanding notice entitlement.
The claim under the Unfair Dismissals Acts, 1977 to 2007 is deemed withdrawn.
