This case came before the Tribunal by way of an appeal by an employee against a recommendation by a Rights’ Commissioner references r-133034-pw-13/EH and
r-133035-pw-13/EH.
Following submissions on a preliminary issue the Tribunal accepted jurisdiction to hear this appeal.
The decision of the Tribunal was as follows:
Much of the evidence from both parties centred on the application and procedure on how employees claim what the respondent labelled as Make-up-Time. It was the appellant’s case the respondent left him financially short on several occasions under that system. In turn the respondent accepted it omitted to discharge payment to the appellant for up to twenty-five and a half hours. Having heard the details on this case the Tribunal finds that in addition to that shortfall a further twelve hours pay is due to the appellant. The Tribunal notes that the appellant accepted part of the original recommendation.
In awarding the appellant €403.12 under the Payment of Wages Acts, 1991 the Tribunal varies the recommendation of the Rights’ Commissioner.
