This case came before the Tribunal by way of an employee appealing the decision of a Rights Commissioner under the Payment Of Wages Act, 1991, ref: r-132850-pw-13/DI. The claim before the Rights Commissioner was dismissed for want of prosecution.
The decision of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the respondent. The Tribunal is satisfied that the respondent was on notice of the hearing.
The appellant gave evidence that he was not paid for the last 7 weeks of his employment and that he was owed €2,750.39. His employer paid him €1,200.00 on 7th February 2013 leaving a balance of €1,550.39 outstanding.
Determination:
The Tribunal upsets the decision the Rights Commissioner and orders that the respondent pays the appellant €1,550.39 under the Payment of Wages Act, 1991.
