These appeals came before the Tribunal by way of a company (the appellant) appealing against a Rights Commissioner Decision (reference: r-136244-pw-13/JT and r-138666,138848-te-13/JT).
Determination:
The Tribunal is satisfied that a notice of hearing was re-sent by ordinary post to the address provided by the appellant company when the registered post was returned marked “not called for.” Neither the appellant company nor a representative on its behalf attended the hearing. Consequently, the Tribunal dismisses the appeals under the Payment of Wages Act 1991 and the Terms of Employment (Information) Act 1994 and 2001 for want of prosecution. The Rights Commissioner Decision (reference: r-136244-pw-13/JT and r-138666, 138848-te-13/JT) stands.
