Determination:
Having heard the evidence adduced the Tribunal determines that the appellant’s position is redundant. The appellant took a leave of absence and on her return her job was not in existence.
The Tribunal is satisfied that a redundancy situation existed and accordingly finds that the appellant is entitled to payment under the Redundancy Payments Acts, 1967 to 2007, based on the following information:
Employment commenced 30th September 1998
Employment ended 24th October 2012
Gross pay €416.92
Non-reckonable service 23rd September 2011 to 24th October 2012
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The claimant under the Minimum Notice and Terms Of Employment Acts, 1973 to 2005 succeeds and the Tribunal awards the claimant the sum of €2,501.52, this being compensation of six weeks gross pay in lieu of notice.
