The determination of the Tribunal is as follows:
The claim under the Unfair Dismissals Acts 1977 to 2007 was withdrawn.
Determination
The Tribunal accepts the appellant’s uncontested evidence that her employment ended by reason of redundancy when the respondent’s business closed down. Accordingly the Tribunal awards the appellant a redundancy lump sum under the Redundancy Payments Acts, 1967 to 2007 based on the following information:
Date employment began: 5 May 2005
Date employment ended: 01 April 2013
Gross Weekly Pay: €500.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The claim under the Organisation of Working Time Act 1997 was successful and the appellant is awarded the sum of €1500.00 in compensation for outstanding holiday pay.
