The decision of the Tribunal was as follows:-
There was no appearance by or representation on behalf of the respondent. The Tribunal is satisfied that the respondent was on notice of the hearing.
The appellant gave evidence that his employment with the respondent company commenced on 15th June 2010. He was put on temporary lay-off on 15th April 2013 which continued until his resumption on 28th April 2014. The employment was terminated on 31st July 2014 due to lack of work.
Determination:
The Tribunal is satisfied that a redundancy situation occurred and that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following information:
Date of Commencement: 15th June 2010
Non Reckonable Service: 15th April 2013 to 25th April 2014
Date of Termination: 31st July 2014
Weekly Gross Pay: €652.31
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period. It should be noted that a statutory weekly ceiling of €600.00 applies to payments from the Social Insurance Fund.
