The determination of the Tribunal was as follows:-
Background:
The claimant commenced employment with the respondent in March / April 2000 until her dismissal on the 10th April 2013 working an average of 24 hours per week and was paid €10 per hour.
Respondent’s Position:
The respondent’s representative informed the Tribunal that he had no witnesses to give sworn evidence in this matter.
Claimant’s Position:
The claimant gave evidence of her loss of earnings since her dismissal on the 10th April 2013.
Determination:
The employer’s representative was given the opportunity of lodging a defence in the form of a T2 form but declined. As a result the respondent was unable to partake in the proceedings.
Based on the uncontroverted evidence of the claimant the Tribunal finds the claimant was unfairly dismissed in this case. Accordingly, the Tribunal awards the sum of €10,000.00 under the Unfair Dismissals Acts, 1977 to 2007.
Loss having been established the Tribunal also awards the sum of €1,440.00, this being six weeks gross wages, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
