The decision of the Tribunal was as follows:
Having heard the uncontested evidence and circumstances that prevented the appellant from submitting her application within the six month time limit the Tribunal find by a majority decision that those circumstances that prevented her from submitting that application were exceptional.
Following evidence on the substantive case the Tribunal upsets the recommendation of the Rights Commissioner and awards the appellant €1824.00 under the Payment of Wages Act, 1991.
