The decision of the Tribunal was as follows:-
The director of the respondent company did not dispute the claimant’s entitlement to an award under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
Determination:
The claims under the Redundancy Payments Acts, 1967 to 2007 and the Organisation of Working Time Act, 1997 were withdrawn.
The Tribunal is satisfied that the claimant had not received payment for his notice period. Based on his service with the respondent from June 2001 to June 2013, the Tribunal awards him the sum of €5,076.96 (this amount being equivalent to six weeks’ gross pay at €846.16 per week) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
