APPEALS OF: CASE NO.

(Division of Tribunal)
Chairman: Mr. C. Corcoran B.L.
Members: Mr. A. O'Mara
Mr. F. Barry
heard this appeal at Dublin on 15th January 2015
Representation:
Appellant: Mr. Blazej Nowak, Polish Consultancy Enterprise,
107 Amiens Street, Dublin 1
Respondent: No appearance or representation
Determination:
There was no appearance or representation for or on behalf of the respondent. The Tribunal is satisfied that proper notification was sent to the respondent. Based on the uncontested evidence of the appellant the Tribunal is satisfied that a redundancy situation existed in this case. The Tribunal finds that the appellant is entitled to a redundancy payment under the Redundancy Payments Acts, 1967 to 2007 based on the following information:
Date of Commencement: 16th June 2006
Date of Termination: 30th September 2013
Gross Weekly Wage: €396.00
The appeal under the Minimum Notice and Terms Of Employment Acts, 1973 to 2005, succeeds and the Tribunal awards the appellant the sum of €1,584.00, as being four weeks gross pay as compensation in lieu of notice.
This award is subject to the appellant having been in employment, which is insurable for all purposes under the Social Welfare Consolidation Act 2005.
