The decision of the Tribunal was as follows:
This case came before the Tribunal by way of an employer appeal of a Rights Commissioner recommendation under the Terms of Employment (Information) Act 1994 and 2001 , reference r-129518-te-13/SR.
The employer told the Tribunal that there was a contract of employment available in the office for the employee. As a contract was not handed to the employee, the employer conceded that they were in breach of Section 3 of the Terms of Employment (Information) Act 1994 and 2001. The employee told the Tribunal that he was not handed a contract of employment.
Accordingly, the Tribunal varies the Rights Commissioner award of €650 and awards the employee €1,000 under the Terms of Employment (Information) Act 1994.
