Case not contested though larger payment was made to the appellant under various legislation.
The decision of the Tribunal was as follows:-
This case came to the Tribunal as an employee appeal for implementation under the Terms of Employment (Information) Acts, 1994 and 2001, of Rights Commissioner Decision r-125568-te-12/SR by which the employee was awarded the sum of five thousand euro under the said legislation.
The appellant stated to the Tribunal that there had been no appeal of the five thousand euro award made to her under the terms of employment legislation and that she had not received a specific payment of the five thousand euro due to her under terms of employment legislation as opposed to any greater amount due to her under various legislation. She stated that, given that there had been no appeal by the employer, the award of five thousand euro under the said legislation had to be implemented.
Determination:
Given that there had been no employer appeal nor specific payment under terms of employment legislation, the Tribunal allows the employee appeal for implementation under the Terms of Employment Acts, 1994 and 2001, of Rights Commissioner Decision r-125568-te-12/SR by which the employee was awarded the sum of five thousand euro.
