CASE NO.
PW27/2014
APPEAL OF:
Gerard O'Connor
against the recommendation of the Rights Commissioner in the case of:
ISS Ireland Limited
under
PAYMENT OF WAGES ACT 1991
I certify that the Tribunal
(Division of Tribunal)
Chairman: Mr R. Maguire, B.L.
Members: Mr M. Carr
Mr C. Ryan
heard this appeal at Dublin on 28th May 2015
Representation:
_______________
Appellant: Mr. Joseph Burke, McCartan & Burke, Solicitors, Iceland House,
Arran Court, Smithfield, Dublin 7
Respondent: Mr Bill Austin, IBEC, HR Executive, 84-86 Lower Baggot Street, Dublin 2
Background:
This appeal came before the Tribunal by way of an appeal against a Rights Commissioner Decision (reference: r-133315-pw-13/DI).
Determination:
The Tribunal is satisfied that a notice of hearing was sent to the address provided by the appellant. He did not attend the hearing and his representative outlined numerous attempts to contact his client. Consequently, the Tribunal dismisses the appeal under the Payment of Wages Act 1991 for want of prosecution.
Sealed with the Seal of the
