Determination:
The respondent company was notified of the hearing to its registered office but failed to appear at the hearing. The appellant stated that she was employed by the respondent company from 2007 but went on sick leave in September 2010. Her employment terminated when the restaurant closed down.
The Tribunal finds that the appellant is entitled to a lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
Date of Commencement: 07 August 2007
Period of sick leave: 15 September 2010 to 28 June 2013(first 26weeks reckonable)
Date of Termination: 31 March 2013
Gross Weekly Pay: €85.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
