APPEAL OF:
Muhammed Abid Hussein
Against
Kanes Autos Limited
Under
MINIMUM NOTICE AND TERMS OF EMPLOYMENT ACTS, 1973 TO 2005
REDUNDANCY PAYMENTS ACTS 1967 TO 2007
I certify that the Tribunal
(Division of Tribunal)
Chairman: Ms M. McAveety
Members: Mr M. Carr
Ms H. Henry
heard this appeal at Longford on 2nd June 2015
Representation:
Appellant:
Ms Sheila Neary, Longford Citizens Information Service,
Level One, Longford Shopping Centre, Longford
Respondent:
Mr Michael O'Sullivan, ARRA HRD, Castlelost West, Rochfort Bridge, Co. Westmeath
Background:
The appeal under the Redundancy Payments Acts 1967 to 2007 was withdrawn by the appellant.
It was the appellant’s position that he was dismissed by the respondent without statutory notice or payment in lieu of said notice.
On the other hand it was the respondent’s position that the appellant had left his employment without giving due notice to the respondent.
Determination:
The appeal under the Redundancy Payments Acts 1967 to 2007 was withdrawn by the appellant.
It was common case that the appellant’s employment terminated without notice or payment in lieu thereof. The Tribunal having already decided that the appellant was unfairly dismissed by the respondent now awards the appellant €1,980.00 under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
