There was no appearance by or representation on behalf of the respondent. The Tribunal is satisfied that the respondent was on notice of the hearing.
The appellant gave evidence that her employment with the respondent commenced on 5th August 2005. The employment was terminated on 19th October 2014 when she received her P45 but she had been put on temporary lay-off on 10th March when the service station had been vandalized. She submitted an RP50 form to the employer/receiver but could not get it signed.
Determination:
The Tribunal is satisfied that a redundancy situation occurred and that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following information:
Date of Commencement: 5th August 2005
Non Reckonable Service: 10th March2014 to 19th October 2014
Date of Termination: 19th October 2014
Weekly Gross Pay: €398.00
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
