The decision of the Tribunal was as follows:
The Tribunal noted that there was no appearance by or on behalf of the respondent.
The appellant told the Tribunal that the respondent gave him his P45 when one of the respondent’s outlets closed down. The appellant completed an RP77 and sent it by registered post to the respondent. The respondent told the appellant that she was unable to pay redundancy due to financial difficulties.
On the uncontested evidence of the appellant, the Tribunal finds that the appellant is entitled to a redundancy lump sum payment under the Redundancy Payments Acts, 1967 to 2007, based on the following criteria:
