Ms. Wendy Doyle, Solicitor, 3.4 Upper Pembroke Street, Dublin 2, did not contest the appellant's appeal for implementation on the grounds that Rights Commissioner Recommendation r-132809 under the Unfair Dismissals Acts, 1977 to 2007, (by which the appellant was awarded the sum of €15,000.00) had been implemented or appealed.
The determination of the Tribunal was as follows:-
This case came to the Tribunal as an appeal for implementation of Rights Commissioner Recommendation r-132809 under the Unfair Dismissals Acts, 1977 to 2007, by which the appellant was awarded the sum of €15,000.00 (fifteen thousand euro) excluding (in addition to) any redundancy payment already made.
Determination:
The Tribunal is satisfied that the Rights Commissioner Recommendation r-132809 made under the Unfair Dismissals Acts, 1977 to 2007, by which the appellant was awarded the sum of €15,000.00 which sum did not include any redundancy payment already made, had been neither implemented or appealed. The Tribunal accordingly makes a determination to the like effect and awards the appellant the sum of €15,000.00, excluding (in addition to) any redundancy payment already made, under the Unfair Dismissals Acts, 1977 to 2007.
