This case came before the Tribunal by way of an appeal by the employee (appellant) against the recommendation of the Rights Commissioner (r-138463-te-13/JT) under the Terms of Employment (Information) Act, 1994 and 2001.
Determination:
It was conceded by the appellant that he had received Terms of Employment but that it contained breaches that did not comply with Section 3 of the Act as amended. The Tribunal considers the breaches as minimal technical breaches and varies the recommendation of the Rights Commissioner. The Tribunal awards compensation to the appellant employee in the sum of €10.00 under the Terms of Employment (Information) Act, 1994 and 2001.
