The determination of the Tribunal was as follows:
Based on the uncontested evidence of the claimant that he was told in no uncertain manner to leave his place of work the Tribunal finds that this dismissal was unfair under the Unfair Dismissals Acts, 1977 to 2007. Accordingly, he is awarded €1000.00 as compensation under those Acts.
The Tribunal notes that the claimant did not furnish it, as requested, with documentation pertaining to his remuneration.
The appeal under the Minimum notice and Terms of Employment Acts, 1973 to 2005 also succeeds and the appellant is awarded €800.00 being the equivalent of two weeks’ notice pay.
