Background:
The claimant commenced employment with the respondent on 28th May 2011 and was dismissed on the 9th September 2013. The claimant received no notice and is therefore claiming one weeks’ payment in lieu of notice. She was paid €351.00.
Determination:
The hearing was scheduled to commence at 2.30p.m. However, the Tribunal decided to delay the commencement of the hearing for a period of time in order to ascertain whether the respondent would attend.
The Tribunal was satisfied that the respondent was duly notified of the date, time and location of the hearing and in their absence was satisfied to commence the proceedings at 2.50p.m.
Loss having been established the Tribunal awards the sum of €351.00, this being one weeks’ gross wages, under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
