Determination
The parties in this case also had a Constructive Unfair Dismissal claim heard in the Rights Commissioners. As there is no Minimum Notice entitlement in a case of Constructive Dismissal the claim under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 is dismissed. By the claimant’s own evidence he received his full annual leave entitlement, therefore the claim under the Organisation of Working Time Act, 1997 is dismissed.
